Competition policy includes a complex institutional network dedicated to ensuring the proper functioning of the markets. There are competition authorities both at the national and European Union level and also in the Spanish Autonomous Regions.
The Comisión Nacional de la Competencia (CNC) is the public agency in charge of preserving, guaranteeing and promoting effective competition in markets at the national level. The CNC exercises its function at a nationwide scale and is related to all markets and sectors of the economy.
European Community legislation gives the competition authorities of Member States power to apply articles 101 and 102 of the Treaty in certain specific issues (Regulation No 1/2003), so that the CNC can in certain situations, also investigate cases that go beyond the Spanish jurisdiction.
